Man Blames Faulty Sprint Fidelis Leads for PTSD

January 30th, 2008 · No Comments

Donald Larry Jackson filed suit earlier this month against Medtronic with a unique claim. He says that Medtronic’s faulty Sprint Fidelis Leads, already the target of many lawsuits, were responsible for giving him post-traumatic stress disorder and forced him to seek psychiatric care.

Defibrillator leads are part of an implanted cardiac defibrillator (ICD) and deliver electrical pulses to the heart. When a lead breaks, it may fail to deliver needed shocks or give unnecessary shocks. These unnecessary shocks have been described by survivors as extremely painful, not to mention the risk of death. Medtronic’s Sprint Fidelis leads have been faulted for being too thin and prone to shatter.

In his claim, Jackson alleges that the unexpected and painful shocks he received due to his broken leads caused him emotional and mental distress and constitute civil battery. He is seeking punitive, exemplary, and compensatory damages, a declaratory judgment, restitution of disgorgement of profits, attorney fees, prejudgment interest, and other equitable relief as requested and is seeking claims of relief for products liability, breach of implied warranty, negligence, intentional infliction of emotional distress, negligent infliction of emotional distress, violation of consumer protection statutes, breach of express warranties, unjust enrichment, battery, and negligent misrepresentation.
